The Delhi High Court on April 9 dismissed the plea by Chief Minister Arvind Kejriwal challenging his arrest by the Enforcement Directorate (ED) in a money-laundering case linked to the alleged Delhi excise policy scam. The court also upheld the remand order passed by the trial court sending him to ED custody. Mr. Kejriwal is lodged in the Tihar Jail in the national capital till April 15 after his judicial custody was extended by the Rouse Avenue court in Delhi on April 1.
The verdict was pronounced by Justice Swarana Kanta Sharma after hearing extensive arguments on April 3. Upholding the Chief Minister’s arrest, the Judge said that the ED was able to place enough material which included statements of approvers, hawala dealers as well as AAP’s own candidates to ascertain that Mr. Kejriwal was given money in cash for expenditure in the Goa assembly elections.?
“The material collected by ED reveals Mr Arvind Kejriwal conspired and was actively involved in use and concealment of proceeds of crime. The ED case also reveals that he was involved in his personal capacity as well as convenor of AAP”, the Court said.?

During the proceedings, senior advocate Abhishek Manu Singhvi appearing for Mr. Kejriwal argued that the arrest is motivated to ensure that the Chief Minister is unable to participate in the upcoming Lok Sabha polls. He also pointed out that the ED has been unable to recover any evidence linking the “proceeds of the crime” to Mr. Kejriwal.?

The ED however opposed the plea, saying that Mr. Kejriwal cannot claim immunity from arrest on the ground of upcoming elections. Additional Solicitor General SV Raju appearing on behalf of the agency said that it is “beyond any doubt” that the scam took place and that the Chief Minister has been arrested in a “dual capacity” – individually as well as in his role as the convenor of AAP.?
